Sponsor Sen. Kelli Stargel contended her bill would add some predictability to divorce settlements. Opponents, though, said it will place a financial burden mostly on women. The House has a similar measure pending.
SB 718 would virtually end permanent alimony awards and set guidelines for courts to use in awarding support in divorce cases. An opponent says it will hurt women if it becomes law.
A top priority for the Florida Medical Association has now made it through two committees in the Florida House.
Issues facing the Legislature in this coming session include the wrangle over attorneys' fees in regard to the state's no-fault insurance system, and how to finance the state's court system in the face of dwindling income from its tradition source of revenue.
In both cases, plaintiffs alleging negligence on the part of the nursing homes had challenged the agreements on public policy grounds, arguing the limits on punitive damages conflicted with state law. The 2nd District Court of Appeal had ruled in both cases that it was up to the arbitrator, not the courts, to determine whether the agreements were invalid.
Florida's attorney general spelled out a set of recommendations that would bring answers to a process that has been criticized for a lack of transparency.
