The full 1st District Court of Appeal has refused to hear a case in which a three-judge panel ordered environmental groups to pay attorneys fees in a development challenge in Martin County.
Some law observers and a dissenting judge say the case could have a chilling effect on challenges of development. The case already has become a political issue for critics of growth management litigation.
